Terms and Conditions

These Terms and Conditions are issued by On the House Pty Ltd (ABN 25 161 733 393) trading as ON THE HOUSE (“ON THE HOUSE”, “we”, “us”, “our”). By accessing or using our website at www.itsonthehouse.com.au (the “Website”), creating a membership, reserving tickets, purchasing tickets, or entering a competition, you agree to be bound by these Terms. If you do not agree, you must not use the Website.

Part A — General Website Terms

1. Definitions

ACL
means the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Admin Fee
means the ON THE HOUSE administration fee charged per transaction as displayed at checkout.
Bronze Member
means a member on the bronze tier.
Competition
means a skill-based promotion conducted by ON THE HOUSE.
Event
means a performance, screening, or entertainment event promoted via the Website.
Event Organiser
means the promoter, presenter, producer, venue or supplier responsible for the Event.
Handling Fee
means any disclosed fulfilment or processing fee.
Member
means a registered ON THE HOUSE account holder.
Reservation
means a booking made through the Website.
Silver Member
means a member on the silver tier.
Ticket
includes eTickets, vouchers, passes and physical tickets.
Terms
means this entire document.
Website
means www.itsonthehouse.com.au and related booking systems.

2. Acceptance of Terms

  1. By using the Website, creating an account, reserving tickets or entering a Competition, you agree to these Terms and our Privacy Policy.

3. Permitted Use

  1. You may use the Website for personal, non-commercial purposes only.

  2. You must not:

    1. breach any law;

    2. infringe intellectual property rights;

    3. upload malicious software;

    4. impersonate another person;

    5. interfere with Website functionality; or

    6. engage in conduct that damages ON THE HOUSE, Event Organisers, venues, performers or other Members.

4. Member Conduct

  1. Members must behave respectfully when interacting with venues, Event Organisers and performers and must comply with venue rules.

  2. Members must not contact venues directly to alter reservations unless expressly permitted.

  3. Failure to comply may result in account suspension or termination.

5. Website Availability

  1. The Website is provided “as is” and “as available”. We do not guarantee uninterrupted access. To the extent permitted by law, we are not liable for Website downtime or technical issues.

6. Membership Accounts

  1. You must provide accurate details, maintain password confidentiality and keep your details current.

  2. Only one membership per email address is permitted.

  3. You may cancel your membership by written notice.

7. Fair Access Policy

  1. To ensure fairness, ON THE HOUSE may temporarily restrict reservations based on cumulative value of offers received, number of reservations made, or attendance history. Restrictions may apply within a geographic area and may last up to 48 hours (or longer if reasonably required).

8. Suspension and Termination

  1. If you breach these Terms, we may cancel reservations, suspend or terminate membership, and restrict future bookings.

9. Intellectual Property

  1. All Website content is owned by or licensed to ON THE HOUSE. You must not reproduce or distribute content without written consent.

10. Limitation of Liability (Website)

  1. Nothing in these Terms excludes rights under the ACL.

  2. To the extent permitted by law, ON THE HOUSE’s total aggregate liability arising from Website use is limited to the amount paid by you to ON THE HOUSE in the three (3) months prior to the event giving rise to the claim (or AUD $0 if no payment was made).

Part B — Membership & Ticketing Terms

11. Membership Tiers

  1. Bronze Membership. Bronze Members may reserve tickets subject to payment of an Admin Fee per transaction (if applicable).

  2. Silver Membership. Silver Membership costs AUD $25 and is active for 24 hours. During this period, one exclusive reservation may be made without an Admin Fee (unless a promotion states otherwise).

12. Admin Fee

  1. The Admin Fee is a service and processing fee charged per transaction.

  2. The Admin Fee applies each time a reservation or purchase is completed.

  3. The Admin Fee is charged per transaction, not per ticket.

  4. If a Member cancels a reservation and later makes a new reservation (including to correct an error), this constitutes a new transaction and a new Admin Fee may apply.

  5. Except as set out in clause 16, Admin Fees are non-refundable.

13. Member Booking Errors

  1. Members are responsible for ensuring booking details are correct. If correction requires cancellation and rebooking, the rebooking constitutes a new transaction and a new Admin Fee may apply.

14. No Show Fee

  1. If you fail to attend an Event or cancel within 24 hours of the start time, ON THE HOUSE may charge a $10 No Show fee. Repeated no-shows may result in restrictions.

15. Ticket Conditions

  1. Tickets are subject to availability and subject to Event Organiser and venue terms. Unless stated otherwise, ON THE HOUSE acts as agent for Event Organisers.

16. Event Changes, Postponements and Cancellations

  1. Events may be changed, postponed, rescheduled or cancelled by the Event Organiser.

  2. Where you have paid the Event Organiser directly (including reduced-price tickets), refunds of ticket prices are determined by the Event Organiser in accordance with applicable law.

  3. Where you have paid only an Admin Fee in connection with a reservation, the Admin Fee will be refunded only where:

    1. the Event is cancelled by the Event Organiser;

    2. the Event is postponed or rescheduled by the Event Organiser and the originally reserved date can no longer be honoured; or

    3. the Event is materially altered by the Event Organiser such that the reservation cannot reasonably be fulfilled as originally offered.

  4. If the Event Organiser reschedules the Event and you are unable to attend the new date offered, and the original booked date is no longer available, ON THE HOUSE will refund the Admin Fee upon request.

  5. Admin Fee refunds are not automatic and must be requested within a reasonable time after notification of the cancellation, postponement or material alteration.

  6. No Admin Fee refund will be provided where:

    1. the Event proceeds substantially as advertised;

    2. you elect not to attend for personal reasons; or

    3. you fail to attend without cancelling in accordance with these Terms.

  7. Nothing in this clause limits your rights under the ACL.

17. Pricing

  1. All prices are in Australian Dollars and include GST unless otherwise stated. Prices are fixed once confirmed. Admin Fees and Handling Fees apply where disclosed.

18. Payment

  1. Payments are processed via PayPal. We may treat electronic payment instructions as authentic to the extent permitted by law.

19. Delivery

  1. Tickets may be delivered electronically, by post, or via venue collection. To the extent permitted by law, we are not responsible for postal delays outside our control. Members must ensure delivery details are correct.

20. Limitation of Liability (Ticketing)

  1. Subject to the ACL, ON THE HOUSE is not liable for acts or omissions of Event Organisers, venues or performers. To the extent permitted by law, liability is limited to the amount paid for the relevant transaction.

Part C — Competitions

21. Nature of Competition

  1. Competitions are games of skill. Chance plays no part.

22. Eligibility

  1. Entrants must be Members, aged 18 or over, and Australian residents. Employees and immediate family members are ineligible.

23. Entry Conditions

  1. Only one entry per person unless stated otherwise. Entries must not contain unlawful, defamatory, obscene or offensive material.

24. Judging

  1. Entries are judged on creativity, originality and humour (excluding lewd or offensive humour).

25. Prizes

  1. Prizes are not transferable, are not redeemable for cash, and must be claimed within 3 days. If unavailable, a substitute prize of similar value may be provided.

26. Intellectual Property in Entries

  1. By entering a Competition, you warrant your entry is original, assign all intellectual property rights in the entry to ON THE HOUSE, and consent to ON THE HOUSE using, reproducing and modifying the entry without compensation.

27. Competition Liability

  1. Subject to the ACL, ON THE HOUSE is not liable for technical failures, lost entries, third-party issues, or tax consequences.

28. Privacy

  1. Personal information is handled in accordance with our Privacy Policy.

29. Variation

  1. We may amend these Terms at any time. Updated Terms apply to future transactions only.

30. Severability

  1. If any provision is unenforceable, the remainder continues in effect.

31. Governing Law

  1. These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
